The limits of extending criminal liability in a criminal law, the system of which is based on the action of the perpetrator


In this research project, the Department of Criminal Law and Criminal Procedure at the University of Szeged cooperated with the Faculties of Law at the Justus Liebig University of Giessen, and the University of Osnabrück as well. The project was sponsored by the MÖB (Hungarian Scholarship Committee) and DAAD (Deutscher Akademischer Austauschdienst). The aim of the research was to analyze the so called „Vorverlagerung der Strafbarkeit” with the method of comparative law and the dogmatic approach of this phenomenon, which is quite new in the juridical literature.

The research intended to find answers to this question: where should a criminal law founded on the rule of law, and so on the action of the perpetrator, put limits to the so-called “Vorverlagerung”.

German and Hungarian reports were made based on an identical syllabus in the course of the research, and were followed by comparative studies and case analysis.

In the framework of the project more trilateral workshops to two big conferences were held.
