Consumer Protection in Criminal Law

(Summary)


The aim of the project is the independent and innovative elaboration of the so-called „criminal law of consumer protection”. The existence of this part of criminal law should be justified, and the possibility of the development of a scientific system as well. The development of the system should be reached by the evaluation of the existing literature and studying closed criminal records (in cases of offences against the consumers). The elaborated scientific system allows giving applicable guidelines to the justice in order to avoid or end the existing problems in this field. Namely, the interpretation und the application of the rules of consumer protection int he criminal law is very diverging: it calls for more theoretical research and a complex approach on this field. The results of the project should be a monograph of the consumer protection by the criminal law and some other shorter papers on this topic. Furthermore, the proposals based on the elaborated scientific structure can be used in the present codification process.

The aims of the research are the following: the analysis of the models of international police cooperation (horizontal and vertical models), and the structure of influences of the different models upon criminal justice or legislation. The research will cover the analysis of cases of European courts from the point of view how the human rights are protected during the activities of investigating authorities.
